Terms of Service
These terms explain your use of Photopol, your rights in your creative work, and the rules for accounts, subscriptions and credits. Read them with our Privacy Policy and Refunds and Cancellation policy.
About these terms
Photopol operates the creative software service at photopol.us and studio.photopol.us under the Photopol brand. “We”, “us” and “our” refer to Photopol. By creating an account or using the service, you agree to these terms. If you do not agree, do not create an account or use the service.

Accounts and eligibility
You must be at least 18 years old, have reached the age of majority where you live, and be legally able to enter into this agreement. If acting for an organization, you must have authority to bind it and use its material.
Provide accurate account information and protect your credentials and email access. You are responsible for activity you authorize. Do not share access to evade plan limits, use another person’s account without permission or transfer an account without our agreement. Tell us promptly about suspected unauthorized access.
Features and availability
Photopol provides tools to create, edit and organize visual content. Access depends on features actually available in the service and any plan purchased. Product descriptions do not add capabilities that are excluded from the current workspace or from the services listed at checkout.
Image Studio currently offers uploads, manual editing and saved projects. Public AI processing and paid checkout are not yet active. Creating an account does not create a paid subscription. Available paid features and their price will be identified before a purchase is accepted.
Tools and third-party models may change. We may perform maintenance or make changes for reliability, security or legal reasons. Where a change materially affects an existing paid commitment, we will provide notice and any remedy required by applicable law.
Your content and permission to process it
You retain the rights you already have in images, prompts, designs, brand assets and other submitted material. You grant Photopol and providers involved in your requested workflow non-exclusive permission to host, copy, transmit, process and display that material as needed to deliver the service, maintain your workspace and address support or security issues.
This permission does not authorize advertising with your private content or transfer ownership to us. It lasts only as needed for those purposes, including applicable retention and backup obligations described in the Privacy Policy.
You must have permission to use and submit your material, including rights relating to copyright, trademarks, personal data and a person’s image or likeness. Review and obtain the permissions needed before publishing or commercially using your work.
Photopol’s software, interface and brand remain protected by their applicable intellectual property rights. Your account permits use within these terms; it does not transfer ownership of our software or branding.
Acceptable use
Do not use Photopol for unlawful activity, infringement, fraud, deceptive impersonation, harassment, sexual exploitation or abuse, or distribution of illegal content. Do not submit malware, access another account’s information, bypass security or usage limits, or interfere with the service.
Do not present generated or edited material as authentic evidence where that would deceive or harm others. Follow applicable law and the restrictions of models or providers used by your workflow. We may refuse requests or restrict access when reasonably necessary to address violations or protect others.
AI results and creative review
AI output may be inaccurate, unexpected, non-unique or unsuitable for your purpose. Review results before use, especially text, product details, identity, likeness and factual claims. Examples demonstrate creative possibilities, not guaranteed outcomes.
We do not claim ownership of your output merely because you used Photopol. Rights in generated results depend on applicable law, your inputs and relevant model or provider terms. We do not guarantee copyright protection, exclusivity, unrestricted commercial rights or freedom from third-party claims.
Purchases and recurring subscriptions
Before payment, the purchase screen identifies the plan, included allowance, billing interval and price. Website prices are in US dollars; applicable taxes and the final amount appear at checkout. Review and correct your order before paying. Monthly subscriptions renew each billing period until canceled through the billing process.
Paddle, as Merchant of Record, handles payment collection, applicable transaction taxes, receipts, payment support and returns. Photopol supplies the software. Paddle’s buyer terms and payment policies govern its transaction relationship with you.
Failed payment may interrupt paid access or prevent renewal. Recurring price changes will be communicated before taking effect as required by law, with an opportunity to cancel future renewal. No trial, discount or extra paid feature applies unless expressly included in the offer.
Credits and processing
Credits are service units for eligible processing. Costs vary by model and operation and are displayed before confirmation. Pending work may reserve credits until its outcome is known. Credits are not money, cannot be transferred or resold, and have no cash redemption value except where a refund or applicable law requires otherwise.
Monthly subscription credits expire at the end of their billing period and do not roll over. Renewal supplies the allowance for the new paid period. Purchased top-up credits do not expire and remain after cancellation, subject to any refund or reversal of that purchase. An active subscription is required to start a new top-up checkout.
A confirmed failed job may release its reserved credits. Released monthly credits retain their original expiry date. An uncertain outcome can require review before release. Adjusting service credits is separate from refunding a payment.
Storage and files
Storage allowances and per-file limits apply separately from credits. Trashed or hidden files can still use storage. Exceeding an allowance can restrict additional uploads or processing until usage fits the available capacity.
A quota reduction or cancellation does not by itself automatically erase existing files. Account deletion and retention are explained in the Privacy Policy. Keep your own copies of important work; the workspace is not a substitute for an independent backup.
Cancellation, refunds and account closure
Use the billing management link, your Paddle receipt or Paddle payment support before the next renewal to prevent the next charge. Cancellation normally takes effect at the end of the current billing period. It does not automatically request a refund or delete your account.
Refund eligibility and the effect on credits are explained in our Refunds and Cancellation policy. Request account closure through Photopol support and cancel any active subscription as well. Removing local files or stopping use does not cancel recurring billing.
Service issues and suspension
Software and external services can experience outages, delays or errors. We do not promise uninterrupted access, a particular processing time or a specific creative result. Report problems with enough detail to investigate, without passwords or full card details.
We may restrict or suspend access where reasonably necessary for security, abuse prevention, nonpayment, legal requirements or a material breach. Where appropriate, we will explain why and allow an opportunity to resolve the issue. You can ask support to review a restriction. Suspension does not remove refund or consumer rights required by law.
Legal rights and resolving concerns
Nothing in these terms excludes or limits rights, warranties, remedies or liability that cannot lawfully be excluded or limited, including mandatory consumer protections. You retain the protections and dispute procedures applicable to you under the law.
Contact us about service concerns so we can investigate and try to resolve them. Payment concerns can also be raised with Paddle. This does not prevent contacting a regulator, using a lawful payment dispute process or bringing a claim in a court with jurisdiction.
Changes to these terms
We may revise these terms as the service or legal requirements change. The effective date identifies the current version. We give notice of material changes where required and seek agreement where legally necessary. Changes do not retroactively remove rights relating to a completed purchase.
If a provision cannot be enforced, the remainder continues to apply to the extent permitted by law. You may stop using the service and cancel future renewals if you do not accept a change.
